Search Preston County Cases

Start a Preston County case lookup by figuring out which court actually holds the file. Public Circuit Court matters sit in the circuit-record system, while limited-jurisdiction civil, criminal, and traffic cases live in the magistrate system. Family and juvenile access can be restricted. Municipal files may stay with the town that issued the citation. A precise case number is usually the best key. When you only have a name, search it, then let the proper Preston County clerk confirm the match and provide any official copy.

How to Search Cases by Name

Pick the right Preston County court first. Circuit Court and publicly available Family Court entries route through WVPASS, and Magistrate Court cases run through the free Magistrate Case Record Search. No single public portal covers Preston County municipal courts. A municipal ticket belongs with the city or town named on the citation.

  1. Open the West Virginia Court Record Access gateway and choose Circuit or Magistrate.
  2. For Magistrate Court, complete the captcha and enter a first name, last name, or case number.
  3. Use the full legal spelling shown on the court paper and filter to Preston County when that choice is available.
  4. Compare court, case type, filing date, and case number before opening a result.
  5. Read the event and disposition fields, then call the clerk if the result is incomplete or ambiguous.

The magistrate result list caps at up to 30 records. A common name can push the right match past that cutoff. So narrow the search with a case number when you can, and treat one result as less than a complete history.

Preston County Case Lookup Portals

The statewide gateway offers two distinct public paths. WVPASS handles public circuit records, while the Magistrate Case Record Search covers Preston County Magistrate Court matters. They are not copies of each other. Query the wrong one and you may wrongly conclude no case exists.

WV E-File/CourtPLUS serves registered filers as a filing and court case-management system. It is not the public walk-up case lookup. For open discovery, stick with WVPASS, the magistrate portal, or the proper local clerk.

How to Search by Case Number

A case number cuts through confusion between people with similar names. Type it exactly as it appears on the citation or clerk notice. Match the letters, digits, and punctuation alike. The Magistrate Payment System shows formats such as ##-M##X-##### and M##M-##########. The identifier on the Preston County record always controls.

The payment search takes a Citation ID Number, Case ID Number, or Payment Plan ID Number. Citation County is optional. That system can find a payment path. Yet it is not a full docket, and it hands out no certified records. For the complete magistrate event history, go back to the case search. You can also contact Room 201. Circuit Court matters go through WVPASS or Lisa Leishman’s office.

Preston County Magistrate Search Gate

The Magistrate Case Record Search greets you with a welcome and captcha step. Expect that control. It blocks automated queries before the public form loads. Finish the verification, continue to the search, and use the narrowest identifier you have. The official captcha entry route shows the notice. It comes right before the Preston County case lookup.

That screen also frames the results as a public information aid rather than a certified case file. Call the Magistrate Clerk for a specific copy. The same office can help when the search returns no reliable match.

What a Case Search Shows

A Preston County case result can blend a header, event history, charges, bonds, parties, and outcome fields. Not every field applies to every case. Read the court and case ID first. Then work through the detail in context.

Basic case informationCase ID, location, description, filing date, type, trial type, amount, appearance date, and agency where applicable.
ChargesCharge number, citation, offense date, statute, plea, disposition, magistrate, and due date.
BondType, set amount, posted amount, status, receipt, payor, and key dates.
Case Event ScheduleEvent number, type, date and time, room, location, judge, and reason closed.
PartiesRole, public name field, and end date where shown.
ResultDisposition text, judgment, plea, transfer, appeal, or another final or post-judgment entry.

A short status is not the filed order. When the exact legal text matters, request the document from the Preston County clerk who holds it.

Preston County WVPASS Case Search

WVPASS went statewide on March 10, 2025. The judiciary described public circuit records and documents dating to 1999. Registration and search cost nothing. Ordinary public users pay 25 cents per page plus a nominal card-processing fee to download documents, though counsel of record download their own case documents free of that charge.

The coverage date sets a useful cutoff. A pre-1999 Preston County Circuit Court file may take a call or visit to the Circuit Clerk, where older books, paper files, microfilm, or archived material get checked locally. An empty WVPASS result does not prove the older case never existed. Sealed filings and juvenile cases also stay out of the public release.

County vs Statewide Case Search

Both public databases are statewide, yet local clerks keep the records. The state tools help you locate a Preston County case and view public data. The Circuit Clerk in Room 301 validates circuit and Family Court records. The Magistrate Clerk in Room 201 supplies magistrate copies. That office can also check a setting the portal leaves unclear.

The County Clerk at 106 West Main Street keeps county commission, fiduciary, probate, and land records. That office is not a stand-in for the Circuit Clerk. Both titles say “clerk,” but the jobs differ.

Missing Preston County Municipal Cases

A municipal citation may not show up in WVPASS or the Magistrate Case Record Search. Preston County cities and towns keep their own locally authorized ordinance and ticket files. Start with the court name printed on the citation. Call that municipal office with the citation number. Ask whether the case stayed local or moved to a county court.

If the citation names Magistrate Court, use the statewide magistrate search. The exact-ID payment route works too. If a municipal matter was appealed to Circuit Court, get the new county case number before trying WVPASS. The switch in court often creates a fresh search key.

Restricted Cases and Access Rules

Privacy rules narrow what any Preston County docket search can return. WVPASS leaves out juvenile matters and sealed files. Under Family Court Rule 6, the orders and case indices stay public. Most other family court papers do not. Pleadings, exhibits, recordings, and transcripts are treated as confidential. Parties, their lawyers, guardians ad litem, authorized designees, and people with standing can still get access. A court order can open a file to others. Two more rules matter here. West Virginia Trial Court Rule 10.03 lets a judge restrict a civil file with an order spelling out its scope, reason, and duration. Juvenile records carry their own protection under state law and Juvenile Rule 10. So when a docket entry never appears, the cause may be the file's age. It may be the court involved or a lawful limit, rather than a mistake in your search.

Preston County Search Result Limits

The magistrate portal itself warns that any record you pull may fall short of a full civil or criminal history. The system also caps results at 30 records, which makes a broad name query a poor idea. Narrow the search instead. Verify the spelling. Enter the full case ID. Confirm that Preston County is truly where the case was filed.

Verify with the custodian. Call the Circuit Clerk for circuit or Family Court files, the Magistrate Clerk for magistrate files, and the issuing municipality for local court files.

Still nothing? Then go in person. Visit the right counter or the magistrate public terminal, or send a written request to the record custodian under West Virginia law, keeping it reasonably specific. Inspection, a plain copy, and a certified copy are three different products. Ask for the one you actually need. Once the case turns up, the Preston County court record search process walks through the document request.
