Search Preston County Court Dockets

A Preston County court docket records the steps in a case, from filing through hearings and disposition. Yet there is no single local list for every court. To search the Preston County court docket, first decide whether the matter belongs to Circuit, Family, Magistrate, or a municipal court. West Virginia provides separate statewide systems for Circuit Court documents and Magistrate Court case details. The local clerk remains the source for confirmation and official copies. A careful Preston County docket search therefore starts with the right court and ends with the office that keeps the original file.

Preston County Has Two Search Portals

Two portals cover Preston County. WVPASS handles Circuit Court documents open to the public. Both registration and searching cost nothing. Downloads run 25 cents per page plus a card-processing charge. Magistrate Case Record Search skips registration entirely. It takes a first name, last name, or case number. It caps results at 30 records. Bring a precise case number when the name is common.

Inside a Preston County Court Docket

Think of a docket as a timeline, not the whole file. Magistrate records label the header Basic Case Information and the hearing block Case Event Schedule. Charges or claims can sit beside the case identifier. Parties, bond data, events, and a disposition may share the same record. Circuit dockets go further. They may list pleadings, orders, and judgments. Public document images are available through WVPASS.

Case IDThe unique number used to separate the case from people with similar names.
PartiesNames and roles tied to the public case record.
FilingsThe dated register of papers, motions, orders, and judgments.
Event ScheduleEvent type, date and time, room, location, judge, and any reason closed.
Charges or ClaimPublic charge, citation, agency, plea, or civil amount fields where applicable.
DispositionThe recorded outcome of a charge, claim, or case.

Preston County Case Event Terms

Event labels need context, not a quick read. A setting is just a scheduled court event, and it is not automatically a trial. A closed event might mean one hearing ended, moved, or was replaced. The case itself stays open. Check the later rows before treating any single status as the outcome.

Continuance
An order moving a hearing or deadline to a later time.
Preliminary hearing
A Magistrate Court stage used in a felony matter before it proceeds in Circuit Court.
Arraignment
A stage when a charge is stated and a plea is entered.
Disposition
The result recorded for the case or an individual charge.
Reason closed
The portal field explaining why that event row ended; it may not close the whole case.

Courts That Keep Dockets in Preston County

Preston County splits its clerk duties. Lisa Leishman, the Circuit Clerk, keeps Circuit and Family Court records. The Magistrate Clerk holds civil, criminal, small-claims, domestic-violence, and traffic files. Municipal clerks keep local ordinance and citation papers. One more split matters. The Preston County Clerk, despite the title, runs county commission, fiduciary, probate, and land work from the courthouse annex, not the Circuit or Magistrate docket.

Room 301 or Room 201?

Room numbers decide where you stand in line. The official Preston County court roster puts both clerk offices inside the Preston County Courthouse. The address is 101 West Main Street in Kingwood. Circuit and Family files belong to the Circuit Clerk in Room 301. Magistrate files go to Room 201. The courthouse history adds detail: Family Court and probation sit on the first floor. Magistrate Court is on the second. The Circuit Clerk, judges, and courtroom sit up top.

The County Clerk works from 106 West Main Street, Suite 103, across the road. That office fits probate, fiduciary, land, or county commission records. It cannot substitute for the Circuit Clerk. Call ahead before visiting. The county posts no single counter schedule or public-terminal location. A phone check saves a wasted trip.

How to Find Court Dates and Settings

Magistrate case? Open the Case Event Schedule. Find the newest event not marked closed. Note its date, time, room, location, judge, and event type. For Circuit and Family matters, read the WVPASS register and any notices first. Call the Circuit Clerk if the live setting stays unclear. Preston County offers no standalone daily calendar portal. The detailed Preston County court dates walkthrough also explains continuances and emergency closures.

Paper goes stale after a continuance. West Virginia's court-closure page shows county status, yet it cannot replace a case-specific order. Weather, an emergency day, or a closed event should prompt a call. Call the originating court. Never assume a hearing vanished. One portal row closed, but missing a date can carry serious consequences for the case.

Preston County Dockets After Continuance

A reset reads like a chain, so work it in order. Find the old event and check its reason-closed field. Then scan for a later notice, continuance, pretrial hearing, or trial entry. Last, confirm the live date with the clerk. A continuance moves an event; it never dismisses the case. An event can move.

Setting check: Use the newest docket event, compare it with the latest order or notice, and call the court when the two do not match.

Public Access to Court Dockets

West Virginia law starts from public inspection but honors court-ordered and statutory limits. Send any record request to the office that actually holds the file. State Trial Court Rule 10.04 promises access during usual business hours. The rule stays subject to limits protecting records and court operations. Specific requests work best. Name the court, case number, document, date range, and format. Say whether you need certification. That beats asking for everything tied to a name.

Key Preston County access rules:

W. Va. Code § 51-4-2 permits inspection and copying of court records unless a record is specially restricted.

W. Va. Code § 29B-1-3 requires reasonable specificity and sets the public-body response framework.

Trial Court Rules 10.03 and 10.04 address access, sealed material, custody, and reasonable protection of court records.

Family Court Rule 6 keeps orders and indices public while restricting much of the underlying family file.

Missing Preston County Court Records

A blank search result means little. Some Preston County Circuit records from before 1999 fall outside WVPASS. So an older case can exist yet stay hidden. Juvenile proceedings are closed unless a law opens them, and sealed material never shows up in public results. Family Court is a patchwork by design. Orders and indices are generally public. But pleadings, exhibits, recordings, and transcripts stay confidential under Family Court Rule 6 in most cases.

Before giving up, check the court level and the spelling. Try the exact case number too. A city citation belongs to the issuing municipality. WVPASS does not turn into a municipal database just because the town sits inside Preston County. A record should be public but still is not there? Call the responsible clerk and describe the item precisely.

Docket Records at the Clerk's Office

The clerk's office does what no website can. Staff can validate the online index. They can pull older paper or scanned court records, and lay out the copy options. Preston County posts no certified-copy web form, no email request route, and no complete counter fee schedule. So ask in person or by mail: what payment works, and do you need a plain or certified copy? For copies a Circuit Clerk lets leave the office in the circumstances covered by § 59-1-11, West Virginia law sets $1 per page. Always confirm the charge for your exact request.

The Magistrate search costs nothing. Its official release, though, sends copy requests to the local clerk. A nominal statutory fee applies. Magistrate clerk offices also keep public access terminals. One phone call settles availability and cost. The procedural manual warns that clerks need not do extensive research over the phone.

Preston County CourtPLUS Milestone

Preston County went live on West Virginia Circuit and Family Courts E-File/CourtPLUS on September 25, 2023. The state reported every county live by July 15, 2024. CourtPLUS handles filings and the court's electronic case work. That covers attorneys, agencies, and other authorized users. Self-represented parties file through the clerk instead. It is not the public WVPASS docket search.

The official CourtPLUS overview describes electronic registers, filing receipts, and verification codes stamped on e-filed orders. For everyone else, the chain stays simple: search, read what is open, then ask the Circuit Clerk to confirm a case entry or issue a certified document. The codes matter when you check an order.

Preston County Circuit Filing Mix

The judiciary's 2025 annual report puts Preston County's workload in numbers. No private case is exposed. Circuit Court logged 104 felony filings and 133 general civil filings. It also logged 12 domestic-violence civil appeals, 6 administrative appeals, and 4 other appeals. Family Court saw 193 divorce, 266 parental-rights, 125 support/custody, and 90 domestic-violence filings. Magistrate civil filings reached 951.

Treat these as aggregate filings, not a live docket count. Final totals live in the annual report archive, while the near-real-time dashboard stays preliminary. The numbers also explain why the civil, criminal, family, or Magistrate search route you pick matters.

The 1934 Preston County Courthouse

Preston County dedicated its current courthouse in 1934. Several earlier court buildings had come and gone before it. An 1850s courthouse burned in 1869, and court briefly convened at Preston Academy. Local quarries supplied the sandstone for the present building. That history matters for docket research. Just because a volume sits in today's building or digital system does not mean it always did. Old court records have moved over the decades.

The official Preston County departments page separates the Circuit Clerk from the County Clerk:

Preston County court docket and clerk departments listing

That split guides the search. Court dockets belong to the Circuit Clerk; probate, fiduciary, land, and commission records belong to the County Clerk.

Preston County Court Dockets by City

The five largest incorporated places in Preston County are Kingwood, Terra Alta, Reedsville, Masontown, and Rowlesburg. A 2020 Census ranking determines the order.
